The applicant has preferred this bail application under Section 439 of CrPC, as he is arrested in connection with Crime No.9/2019, registered at Police Station Sanna, Jashpur (CG), for the offence punishable under Section 18 of the Narcotic Drugs and Psychotropic Substances Act, 1985.

Applicant is owner of agricultural field over which 4516 cannabis plants were planted by him and co-accused Mahendar Singh. From the present applicant 1930 plants have been recovered whereas from the co-accused Mahendar Singh 2586 plants have been recovered.

Although the applicant is in detention since 27-2-2019 but considering the quantity of cannabis plants recovered from the applicant and for the fact that four witnesses have already been examined during trial and physical hearing in Courts in Chhattisgarh has already started, this Court is not inclined to grant bail to the applicant.

Accordingly, the bail application is rejected. However, the trial Court is directed to expedite the trial and conclude the same at the earliest.
