Learned counsel for the petitioner submits that the husband of the petitioner is working at Central School, Dongargarh and the petitioner has been transferred from Ramatola Block Dongardh to sub-health center Khobha, Block Chhuriya against the transfer policy. He submits that as per Clause 1.10 of the transfer policy (Annexure P-4), if the husband and wife both are serving as government employees, they may be posted at the same place as far as practically possible. Therefore, there is a clear violation of the policy.

Perused the documents. Annexure P-2 the Certificate issued by the Kendriya Vidyalaya, Dongargarh shows that the husband of the petitioner is working at Central School, Dongargarh.

Considering the Clause 1.10 of the Policy, the petitioner shall be at liberty to file a detailed representation to the transfer redressal Committee within 15 days and on such representation being filed, the same shall be considered and decided within a further period of 45 days.
