Hon'ble Shri Justice P. Sam Koshy Order on Board 10.08.2018 1.

The petitioner seeks a direction to the respondents to ensure that pensionary benefits and retiral dues payable to the petitioner on the death of her husband who died in harness be released at the earliest. 2.

The State counsel submits that the authorities shall process and decide the case of the petitioner within no time.

3.

Given the aforesaid submissions, this court is of the opinion that no fruitful purpose would be served in keeping this petition pending by admitting the same. Rather, ends of justice would meet if a direction is given to the respondents No.2 & 3 to ensure that the pensionary benefit and retiral dues payable to the petitioner is released at the earliest within a period of 30 days from the date of receipt of certified copy of this order. 4.

It is ordered accordingly.

5.

It shall be the responsibility of the petitioner to ensure a copy of this order is made available to the respondents No.2&3 at the earliest. 6.

The authorities would also consider the aspect of payment of interest for the delayed payment as it appears that the petitioner was not at fault for the inordinate delay for release of the same. Sd/- (P. Sam Koshy Judge inder
