1. The applicant has preferred this application for grant of bail as she is arrested in connection with Crime No.521/2020 registered in Police Station Durg, District Durg for offence under Section 306/34 of the IPC.

2. As per the prosecution case, at about 2.30 am in the intervening night of 28th/29th July, 2020, the deceased was in front of his house having just returned from the dinner party. The applicant with her brothers reached there on two motorcycles driving rashly and negligently to which the deceased objected. Thereafter a quarrel took place in which the applicant and her brothers abused the deceased and his family members filthily and started pelting stones. After the incident, the deceased committed suicide at about 4.45 am in the early morning of 29.7.2020.

3. Considering that the applicant is a lady aged about 38 years, she is in jail since 6.8.2020 and necessary ingredients to constitute offence for abetment to commit suicide, I am inclined to release her on bail.

4. Accordingly, the application is allowed and the applicant is directed to be released on bail on her executing a personal bond for a sum of Rs.50,000/- with one surety for the like amount to the satisfaction of the trial Court. She is directed to appear before the trial Court on each and every date given by the said Court.
