Asha, Panel Lawyer Hon'ble The Vacation Judge Order on Board 25/05/2017 The applicant has preferred this application under Section 439 Cr.P.C. for grant of bail as he has been arrested in connection with Crime No. 315 of 2016 registered at Police Station Arjunda, District Balod (Chhattisgarh) for the offence punishable under Sections 304, 286, 308/34 of IPC and Section 3 & 4 of Explosive Act.

The applicant has a bore-well in the premises belonging to him. As the bore-well had dried up, the applicant engaged one Mukesh Kumar Sahu, bore-well contractor, to repair the bore-well on which the said Mukesh Kumar Sahu carried out a blast through detonator in the bore-well by engaging unskilled labours Thalesh Kumar and Ramdev Sahu. During such procedure, the blast caused death of Thalesh Kumar and Ramdev Sahu. 3.
Admittedly, the contractor Mukesh Kumar Sahu who had carried out the entire operation has been released on regular bail by this Court in M.Cr.C. No. 999/2017.

Considering the release of co-accused Mukesh Kumar Sahu on bail, the present applicant is also entitled to be released on bail.

Accordingly, the bail application is allowed. The present applicant is directed to be released on bail on his executing a personal bond for a sum of Rs.25,000/- with one surety for the like amount to the satisfaction of the concerned trial Court. He is directed to appear before the trial Court on each and every date given by the said Court.
