2. This is an application filed under Section 439 of the Code of Criinal Procedure for grant of regular bail to the applicant, who has been arrested in connection with Crime No.97/2020 registered at Police Station Bango, District Korba, Chhattisgarh for the offence punishable under Section 379/34 of the IPC.

3. The present applicants along with third accused Dev Loni have committed theft of diesel from a trailer at about 5:00 am. on 8.8.2020. The applicants are in jail since 14.10.2020 and the concerned SHO has not reported any previous antecedents of committing similar nature of offence.
4. The charge sheet has already been filed and the offence is triable by the Judicial Magistrate First Class, therefore, considering all the relevant aspects of the matter, this Court is inclined to release the applicants on regular bail.
5. Accordingly, the bail application is allowed and the applicants are directed to be released on bail on each of them furnishing a personal bond for a sum of Rs.50,000/- with one surety each in the like amount to the satisfaction of the trial Court. They are directed to appear before the trial Court on each and every date given by the said Court.
