On due consideration and for the reasons stated in the application, the delay of 78 days in filing the petition is condoned. Also heard on application for leave to appeal. On due consideration, leave to appeal is allowed. Registry is directed to register the case as Acquittal Appeal. Since the respondent has already represented, no further notice is required.

The respondent is directed to furnish a bail bond of Rs.25,000/- before the trial Court within a period of one month so that his presence may be procured in this appeal before this Court as and when needed. List it for final hearing.
