Justice Rajani Dubey Order On Board 15/01/2021 Prayer for restoration of appeal is made on the ground that absence of counsel for the appellant when the case was called on for hearing, was not deliberate. He would submit that the appellant intends to prosecute the appeal. Learned counsel for the respondent would submit that despite several calls, when no one appeared, the appeal was dismissed for want of prosecution. Considering the submission, as last indulgence, we are inclined to grant one more opportunity to argue the matter. For the cause shown in the application, we are inclined to recall order dated 09/07/2018 and restore F.A.No.65/2013, subject to payment of cost of Rs.1,000/- to respondents 1 and 2 and also to respondent No.3 separately.
