At the out set, learned counsel for the applicants would submit that he intends to withdraw the instant MCRCA and the applicants intends to surrender before the CJM, Kondagaon where the matter in Cr. Case No. 107/2012 is pending and the applicants are arrayed as absconding as accused in the said matter. The Court below may be directed to dispose of an application under Section 437 Cr.P.C. on the same day, if possible.

As prayed, the instant MCRCA is disposed of as withdrawn without any appreciation on its merits. If the applicants surrender before the CJM, Kondagaon (CG) in connection with Cr. Case No. 107/2012 and files an application under Section 437 Cr.P.C. the Court below is directed to dispose of the said application on the same day, if possible.
