1. Heard.

2. This is an application filed under Section 439 of the Code of Criminal Procedure for grant of regular bail to the applicant, who has been arrested in connection with Crime No.62/2020 registered at Police Station Mujgahan, Raipur, Civil and Revenue District Raipur (CG) for the offence punishable under Sections 384, 365, 120B, 34 of the IPC.

3. The present applicant along with 5 other co-accused including one Nandini Mishra have hatched a conspiracy to trap victim

MCRC No. 8115 of 2020 Lalit Yadav and in furtherance of the said conspiracy, Nandini Mishra called the victim requesting him to meet at a desired place and when the victim reached there, he was threatened that if he does not pay Rs.50 lakhs, Nandini Mishra would lodge a false report of commission of rape and molestation. At the end of the episode, they extorted Rs.15,000/- from the victim.

4. Co-accused Raja Tiwari, Umesh Hedge, Manoj Hegde and Ajay have previous criminal antecedents. Although the present applicant does not have any criminal antecedents, but there appears a gang operating in the area involving conspiratorial extortion.

5. Considering the manner in which the entire operation was given effect to, I am not inclined to release the applicant on regular bail.

6. Accordingly, the bail application is dismissed with liberty to the applicant to repeat the prayer after examination of the victim. Sd/- (Prashant Kumar Mishra) Judge Shyna
