Chandravanshi Order On Board 28.10.2021 (1) Learned counsel appearing for the applicant seeks permission of this Court to withdraw this anticipatory bail application. He also prayed that observation may be recorded by this Court that if the applicant moves an application for grant of regular bail before the trial Court after his surrender, then the trial Court may decide the regular bail application under Section 439 of the CrPC on the same day. (2) Permission, as prayed for, is granted.

(3) Accordingly, the anticipatory bail application is dismissed as withdrawn. However, it is directed that if the applicant surrenders before the court below and applies for grant of regular bail, then his bail application be decided by the court below on the same day.
