1. The applicant has preferred this application for grant of bail as he is arrested in connection with Crime No.392/2020 registered in Police Station Khairagarh, District Rajnandgaon for offence under Section 376 of the IPC.

2. The prosecutrix, aged about 24 years, had an affair with the applicant for the period more than 2 years from 13.6.2018 to 19.8.2020. She alleges that during this period the applicant committed forcible sexual intercourse on promise to marry. The present FIR has been lodged after the applicant refused to marry the prosecutrix.

3. Considering the age of the prosecutrix, previous love affair and the

MCRC No. 7913 of 2020 delay in lodging the FIR, as also for the fact that the applicant is in jail since 22.10.2020 and the charge sheet has already been filed, I am inclined to release the applicant on bail.

4. Accordingly, the application is allowed and the applicant is directed to be released on bail on his executing a personal bond for a sum of Rs.50,000/- with one surety for the like amount to the satisfaction of the trial Court. He is directed to appear before the trial Court on each and every date given by the said Court.
