At the outset, learned counsel for the applicant would submit that he may be permitted to withdraw the instant MCRC and further prayed that the Court below may be directed to dispose of the matter as expeditiously as possible pending before the CJM Mahasamund, C.G. as Criminal Case No.2598/17 under Section 34(2) of the C.G. Excise Act. 2.

As prayed, the instant MCRC is disposed of as withdrawn without any appreciation on its merit. The Court below, Chief Judicial Magistrate Mahasamund, C.G. is directed to dispose of the matter (Criminal Case No.2598/17) as expeditiously as possible preferably within 6 months from the next date of hearing.
