This is an application filed under Section 439 of the Cr.P.C. for grant of regular bail to the applicant, who has been arrested in connection with crime No.470/2016 registered in Police Station Purani Bhilai, Durg for the offence punishable under Sections 457, 380, 411, & 201/34 of the Indian Penal Code.

Learned counsel for the applicant submits that the applicant is in detention since 26.11.2016, Charge sheet has been filed before Judicial Magistrate First Class, Bhilai as Criminal Case No.781/2016. It is alleged that he supported other co-accused persons to take them in his vehicle for the offence. He was not directly connected with the crime of theft of ornaments worth
Rs.4,80,000/- , he may be given opportunity by enlarging bail during trial.

On the other hand, learned counsel for the State opposes the bail application.

Perused the material.

It appears that the applicant used his car for the alleged theft and also after the incident, he has taken other co-accused in his car. With the above active participation in the offence, this Court does not incline to grant bail to the applicant. 7.
Accordingly, the bail application filed under Section 439 of the Cr.P.C. is dismissed.
