By way of this petition, the petitioners are questioning the inaction on part of the respondents, particularly the Respondent No.2-Chhattisgarh State Power Holding Company Limited, as the said Respondent is not giving any preference in ongoing recruitment to the post of Attendant (Line) to the persons who have passed out and have the certificate of ITI (Industrial Training Institute) in Lineman and Electrician trade.

It is contended that on 12.08.2021, the said Respondent has issued an advertisement for recruitment to the post of Attendant (Line) and the procedure of recruitment and essential qualification for the said post as mentioned in the advertisement is 10th pass from any recognized Board. According to the Petitioners, there is no clause provided in the said advertisement that the preference in ongoing recruitment to the post of Attendant (Line) would be given to the persons who have passed out and have certificate of ITI. It is contended further that as the petitioners, who are ITI certificate holders and are trained/skilled labour, therefore, under such circumstances, the Respondent No.2 ought to give preference to the Petitioners. It is contended further that a representation in this regard has been made by the petitioners on 26.08.2021 (Annexure P-4) before the concerned authorities and praying for issuance of direction to the Respondent No.2 for its consideration.

The aforesaid limited contention has not been opposed by the counsel appearing for the Respondents.

In view of aforesaid contention of parties, the Court feels that no useful purpose would be served in keeping the petition pending as it can be disposed of at this state itself.

Accordingly, this petition is disposed of by directing the Respondent No.2- Chhattisgarh State Power Holding Company Limited to take an appropriate decision on the said representation (Annexure P-4) within a period of 45 days from the date of communication of the order of this Court. It is, however, made clear that while disposing of this writ petition, I have not expressed any opinion on the merits of the case and
concerned Authority shall decide the representation in accordance with law.
