Hon'ble Shri Justice P. Sam Koshy Order on Board 13/08/2018

1. The grievance of the petitioner in this writ petition is to the impugned order (Annexure P/1) dated 31.03.2016, whereby the respondents have ordered for accepting the resignation which is alleged to have been submitted by the petitioner.

2. Perusal of the record shows that though the order dated 31.03.2016 was passed about 21⁄2 years ago, but the petitioner does not seem to have raised any objection or an appeal or a representation against the said order to any of the higher authorities in the department and has straight away after about 21⁄2 years has filed the present writ petition.

3. Unless the petitioner ventilates her grievance with the competent authority, the petitioner would not be entitled to avail the recourse of a judicial review invoking the writ jurisdiction of this Court under Article 226 of the Constitution.

4. Without expressing any opinion on the merits of the case so far as the entitlement or the rights in favour of the petitioner is concerned, the present writ petition stands disposed of with a direction to the petitioner to prefer an appeal/objection against the said order before the higher authorities in the department and on such objection being filed, the authorities concerned are expected to take a prompt decision in accordance with law after due verification of the documents and records available with the respondents.

5. With the aforesaid observations, the writ petition stands disposed off. Sd/- (P. Sam Koshy) Judge Ved
