1. Application for condonation of delay in filing the appeal is misconceived and is accordingly dismissed as withdrawn.

2. In this case, though statements of the witnesses were not filed earlier, this Court had summoned the records of the Court below. We have gone through the same.

3. Heard on application (CRMP) for grant of leave to appeal.

4. Taking into consideration the statements of minor girl and her parents, we are inclined to grant leave to appeal.

5. CRMP is accordingly disposed off.

6. Let the appeal filed by the State be registered as Acquittal Appeal and be listed for further orders.
