Hon'ble Shri Justice Prashant Kumar Mishra Order On Board 05/03/2021

1. The applicant has preferred this bail application under Section 439 of the C.r.P.C., as he has been arrested in connection with Crime No.61/2020, registered at Police Station: Pasta, District- BalrampurRamanujganj (C.G.) for the offence punishable under Section 376 D, 366, 323 of the Indian Penal Code.

2. Applicant alongwith co-accused Birbal committed forcibly sexual intercourse (gang rape) with the prosecutrix one after another.

3. Considering the nature of allegation, I am not inclined to release the applicant on bail at this stage.

4. Learned State counsel would oppose the prayer for grant of bail.

5. Accordingly, the bail application is dismissed reserving liberty in favour of the applicant to revive the prayer after examination of the prosecutrix.
