1. Heard finally.
2. The applicant has preferred this application for grant of bail as he is arrested in connection with Crime No. 415/2016 registered in PS Telibandha, Distt. Raipur for offence punishable under Section 457, 380, 436 and 427 of the IPC. Charge sheet has been filed which is pending before the CJM, Raipur as Criminal Case No. 24070/2016.
3. Learned counsel for the applicant submits that the applicant is aged about 19 and half years. He is in custody since 14-12-2016. He is the first offender and will not commit any offence in future if granted bail. Hence he may be enlarged on bail.
4. Per contra, learned counsel for State opposed the bail application and submits that earlier also Crime No. 258/2016 under Section 457, 380, 511, IPC has been registered against the applicant in the same police station therefore, he has criminal antecedent and may not be enlarged on bail.
5. Perused the material available.
6. The applicant caused mischief for about Rs. 10,000/- as per
panchnama, also fired the articles of the house. He was caught red handed inside the house and when the complainant attempted to control the applicant he showed him knife and threatened and also stolen Rs. 1200/-, ATM, Adhar Card and other articles.
7. In the light of evidence collected against the applicant and as one more similar offence is registered against him, I am not inclined to grant bail to the applicant.
8. Hence the application is rejected.
