Shri Aditya Sharma, Panel Lawyer Hon'ble The Vacation Judge Order on Board 25/05/2017 The applicants have preferred this application under Section 439 Cr.P.C. for grant of bail as they have been arrested in connection with Crime No. 421 of 2016 registered at Police Station Kotwali, Jagdalpur, District Bastar (Chhattisgarh) for the offence punishable under Sections 343, 366 & 354 of IPC.

As per the prosecution case, the accused persons forcibly took away the prosecutrix from lawful possession of her parents, detained her inside a room in the house belonging to the friend of accused Chain Singh Sethiya where Chain Singh outraged the modesty of the prosecutrix. 3.

Admittedly, accused Chain Singh Sethiya has already been released on regular bail in M.Cr.C. No. 521 of 2017 whereas co-accused Sukman, Balram and Puran Kashyap have been allowed bail in M.Cr.C. Nos. 851/2017 and 938/2017.

Considering the release of co-accused persons on bail, this Court is of the opinion that the present applicants are also entitled to be released on bail.

Accordingly, the bail application is allowed. The present applicants are directed to be released on bail on their executing a personal bond for a sum of Rs.25,000/- with one surety each for the like amount to the satisfaction of the concerned trial Court. They are directed to appear before the trial Court on each and every date given by the said Court.
