This revision has been preferred against order dated 23/07/2018 passed in Criminal Case no. 1176/2018 by the Family Court, whereby the learned Family Court while deciding an application under Section 125 (3) of the Code of Criminal Procedure ordered the Applicant to pay maintenance amount of Rs. 28,500/- in three installments. 3.

I have heard counsel for the Applicant.

Vide order dated 25/04/2016, the Family Court, Durg in MJC No. 1042/2014 allowed the application submitted under Section 125 of the Code of Criminal Procedure by the Respondent and ordered the Applicant to pay monthly maintenance of Rs. 3000/-. For recovery of

maintenance amount from 25/11/2016 to 25/10/2017 i.e. total Rs. 33000/-, an application under Section 125 (3) of the Code of Criminal Procedure was filed by the Applicant/Wife. On 23/07/2018 on the request of the Applicant himself, the learned Family Court directed him to pay remaining maintenance amount of Rs. 28500/- in three installments. Thus, this revision has been filed by the Applicant. 5.

Since installments have been fixed on the request of the Applicant himself by the Family Court, thus I do not find any merit in this revision. 6.

Accordingly, this revision is dismissed at motion stage itself. Sd/- (Arvind Singh Chandel) Judge Rahul
