Shri Aditya Sharma, Panel Lawyer Hon'ble The Vacation Judge Order on Board 25/05/2017 The applicant has preferred this application under Section 439 Cr.P.C. for grant of bail as he has been arrested in connection with Crime No. 89 of 2017 registered at Police Station Civil Lines, District Raipur (Chhattisgarh) for the offence punishable under Sections 294, 323, 506, 452, 34 of IPC. 2.
The applicant has allegedly abused, criminally intimidated and caused grievous hurt by restraining the complainant Smt. Koushalya Sahu at about 9 p.m. on 03.02.2017.

Though the concerned SHO has reported six previous criminal cases against the present applicant, those offences do not involve commission of any heinous crime by the applicant. As per the applicant's counsel, out of the six cases, the applicant has already been acquitted in four of them. 4.
Considering the fact that the present offences are triable by the JMFC and the applicant is in jail since 04.02.2017 i.e. more than 3 1⁄2 months, this Court is inclined to release the applicant on bail 5.
Accordingly, the bail application is allowed. The present applicant is directed to be released on bail on his executing a personal bond for a sum of
Rs.25,000/- with one surety for the like amount to the satisfaction of the concerned trial Court. He is directed to appear before the trial Court on each and every date given by the said Court.
