Learned counsel for the applicant would submit that the applicant is arrested in Crime No.71/2016 by Lundra police, District Sarguja under Section 420, 34, 120B of the IPC on 18-09-2016. The charge sheet has been filed. The trial is pending before the JMFC, Sarguja at Ambikapur, C.G. who had registered the Criminal Case No.1825/2016. There is no any knowledge regarding the fact whether charges are framed or not. As per the allegation, the applicant is the main accused who had taken money as alleged for about Rs.22,55,000/- from many persons and assured them for their appointment on different posts in the Govt. of C.G.; but nothing has been recovered from the applicant. Hence, looking to the fact that there is no recovery, the applicant may be enlarged on bail.

Per contra, learned counsel for the non-applicant/State opposed the argument advanced on behalf of the applicant and would submit that allegation of cheating of Rs.22,55,000/- from many of the victims is reported. Police had filed the charge sheet after investigation. The offence committed is of serious nature.

On due consideration, for the material collected by the prosecution against the applicant, the applicant is the main accused, I am not inclined to grant bail to the applicant. Consequently, the instant MCRC is hereby dismissed.
