1. Heard.
2. This is the First Bail Application filed under Section 439 of the Code of Criminal Procedure for grant of regular bail to the applicant who has been arrested on 28.06.2021 in connection with Crime No. 733/2021 registered at Police Station Sarkanda, District Bilaspur (CG) for the offence punishable under Section 21 of N.D.P.S. Act.
3. As per the prosecution case, on 28.06.2021 on a raid being conducted from the possession of the applicant 103 piece of Buprenorphine (2 ml each total 206 ml) injections were recovered. Thereby the offence has been committed.
4. Learned counsel for the applicant submits that the applicant has been falsely implicated. He would further submit that the wife has made the report and the applicant was initially taken from the house thereafter the seizure was made, therefore, no offence is made and the applicant may be released on bail.
5. Per contra, learned State counsel opposes the prayer for grant of bail and would submit that on a raid being conducted the seizure was made.
6. Taking into the statement of the parties and perusal of the case-diary and charge-sheet, at this stage I am not inclined to release the applicant on bail.
