Grievance of Petitioner in the present Contempt Petition is the noncompliance of Order dated 20.3.2019 passed by this Court in WPS No.2033/2019.

During the course of hearing, learned Counsel for Respondent No.1 submits that after the Order was passed by this Court, the Respondents have now on scrutiny of the records found that the Petitioner was entitled for an amount of Rs.1,02,952/- and which has already been released to Petitioner.

Learned Counsel for Petitioner however submits that the amount does not seem to be properly calculated by Respondents. According to him, the Petitioner is entitled for Rs.3.00 Lakh whereas he has got about Rs.1.00 Lakh.

Given the said submission by learned Counsel for Petitioner, what is admittedly clear is that the Respondents have after disposal of the original Writ Petition scrutinised the claim of Petitioner and found that the Petitioner is entitled for an amount of Rs.1,02,952/-. Now, in case the Petitioner disputes the said amount, he will have to file a fresh Writ

Petition in respect of balance of amount on the basis of cogent documents which he has, if any. Part payment means to part compliance and part compliance would not amount to contempt.

Accordingly, reserving the right of Petitioner to avail appropriate remedy afresh, the Contempt Petition stands disposed of. Sd/- (P. Sam Koshy) Judge /sharad/
