1. Heard finally.
2. The applicant has preferred this application for grant of bail as he is arrested on 24-1-2017 in connection with Crime No. 43/2017 registered in PS Arang, Distt. Raipur for offence punishable under Section 34 sub-section (2) of the CG Excise Act.
3. Learned counsel for the applicant submits that after investigation charge sheet has been filed against the applicant which is pending before the JMFC, Raipur as Criminal Case No. 2157/2017. This is first bail application before this Court. He has no criminal antecedent. As per allegation, 164.160 bulk litre foreign liquor has been seized from the conscious possession of the applicant without any licence or permission. If bail is granted, he will not repeat the offence. Therefore, the applicant may be enlarged on bail.
4. Learned State counsel opposes the bail application. He further submits that huge quantity of foreign liquor has been seized from the possession of the applicant. Earlier also Crime No. 412/2014 for offence under Section 36 sub-section (3) of the CG Excise Act has been registered against him.
5. On due consideration, looking to the quantity of the liquor seized from the applicant, I am not inclined to grant the bail to the application.
6. The bail application is dismissed.
