1. The applicant has preferred this application under Section 439 of Cr.P.C. as he is in jail since 26.09.2020 in connection with Crime No.250/2020 registered at Police Station- Kotwali, Raipur, District Raipur, C.G. for the offence punishable under Section 34 (2) of the C.G. Excise Act.

2. Learned counsel for the applicant submits that he does not want to prosecute this application and seeks to withdraw the same.

3. Permission granted.

4. Accordingly, the application MCRC No.7998 of 2020 is dismissed as withdrawn.
