NAFR HIGH COURT OF CHHATTISGARH, BILASPUR WP227 No. 600 of 2019 Bisen Hathile, S/o Shri Lalaram Hathile, aged about 32 years, R/o Village Sorha, Police Station Pandatarai, Tahsil Pandariya, Civil & Revenue District Kabirdham, Chhattisgarh. ---- Petitioner
Versus
Smt. Pinky Hathile, W/o Shri Bisen Hathile, Aged about 30 years, R/o Village Sorha, Police Station Pandatarai, Tahsil Pandariya, Civil & Revenue District Kabirdham, Chhattisgarh. ----Respondent For Petitioner :
Mr. Paras Mani Shriwas, Advocate Hon'ble Shri Justice Sanjay K. Agrawal Order On Board 01.08.2019
1. The petitioner and the respondent in the present writ petition are husband and wife. In a proceeding initiated under Section 25 and 26 of the Hindu Marriage Act, 1955, the respondent and her minor children have been granted maintenance from the petitioner. For revoking the order of maintenance and for dispossessing the respondent from her house in possession, the petitioner herein filed an application which was rejected by learned Family Court, Kabirdham finding no merit, by order dated 13/12/2018 against which this writ petition under Article 227 of the Constitution of India has been preferred by him.
2. I have heard learned counsel for the petitioner at length.
3. Learned Family Court has assigned sufficient and valid reasons for declining the grant of the application filed by the petitioner which is neither perverse nor bad in law. As such, I do not find any merit in this writ petition.
4. Being devoid of merit, this writ petition deserves to be and is accordingly dismissed. No cost(s).
