Challenge in this petition is to the order passed by the Special Judge (Electricity Act), Surajpur, before whom the complaint under Section 135 of the Electricity Act was preferred by the respondents.

The impugned order is a judicial order, which cannot be assailed by issuance of any writ under Article 226 of the Constitution of India.

At this stage, learned counsel for the petitioner seeks permission of the Court to withdraw the writ petition with liberty to challenge

the order before the appropriate forum having jurisdiction over the matter.

Accordingly, the writ petition is dismissed as withdrawn with the aforesaid liberty.
