This is an application filed under Section 439 of the Code of Criminal Procedure for grant of regular bail to the applicant, who has been arrested in connection with Crime No.391/2020 registered at Police Station Basna, District Mahasamund (CG) for the offence punishable under Section 20-B of the NDPS Act. 3.

The present applicant and co-accused Sudhanshu were found in joint illicit possession of 4 Kg of Ganja on 14.8.2020. 4.

Learned counsel for the State would oppose the prayer for grant

MCRC No. 8053 of 2020 of bail. However, he would submit that the concerned SHO has not reported any criminal antecedents of the applicant. 5.

Considering the quantity of Ganja recovered from the applicant and the fact that the applicant is in jail since 14.8.2020 and the charge sheet has already been filed, I am inclined to release him on regular bail.

Accordingly, the bail application is allowed and the applicant is directed to be released on bail on his furnishing a personal bond for a sum of Rs.50,000/- with one surety in the like amount to the satisfaction of the trial Court. He is directed to appear before the trial Court on each and every date given by the said Court. 7.
