The grievance of the petitioner in the present writ petition is the inaction on the part of respondent No.2 in not considering the claim of the petitioner so far as third time pay scale is concerned on completion of his 30 years of service as the representation made in this regard on 27.03.2019 (Annexure P-9) has not been decided till date.

Counsel for the petitioner submits that even before the petitioner had retired, the respondents had issued the circular/resolution dated 08.08.2018 (Annexure P-6) and 30.07.2019 (Annexure P-8), whereby they had ordered for grant of third time pay scale on completion of requisite length of service. The petitioner has got the requisite length of service and as per the

circular/resolution of the respondents was issued while the petitioner was in service, yet the respondent No.2 has not calculated the said benefits to the petitioner and has not extended the same till now. 3.

Given the limited grievance that the petitioner has, the writ petition at this juncture stands disposed of directing the respondent no.2 to take appropriate decision on the petitioner's representation made on 27.03.2019 (Annexure P-9) so far as claim of the petitioner for third time pay scale is concerned.

Let respondent No.2 take a decision on due scrutiny of the entitlement part of the petitioner in terms of the circular/resolution governing the field within an outer limit of 90 days from the date of receipt of copy of this order. 5.

With the above observations, the writ petition stands disposed of accordingly.
