Hon'ble Shri Justice Narendra Kumar Vyas Order On Board 06.10.2021 1.

The petitioner has filed this writ petition under Article 226 of the Constitution of India being aggrieved by Forest Crime No. 10784/2018 dated 15.01.2018 and confiscation proceeding with regard to Vehicle Tata Truck bearing No. CG15 AC 3529. Vide order dated 09.10.2020, the Forest Officer ordered for confiscation of the aforementioned vehicle. Thereafter, the petitioner has preferred an appeal before the appellate authority. 2.

Learned counsel for the petitioner would submit that the appeal is still pending before the appellate authority for more than nine months, therefore, the petitioner has filed this petition. He further submits that the appellate authority may be directed to decide the appeal of the petitioner at the earliest.

As the appeal is pending for more than nine months before the appellate authority, the appellate authority is directed to decide the

appeal of the petitioner within a period of 45 days from the date of receipt of copy of this Court, in accordance with law. 4.

With these observations and directions, the instant writ petition stands disposed of.
