These are the two applications filed under Section 439 of the Code of Criminal Procedure for grant of regular bail to the applicants, who have been arrested in connection with Crime No.1/2020 registered at Police Station Amlipadar, District Gariyaband (CG) for the offence punishable under Sections 294, 323, 506(B), 307/34 of the IPC.

3. As per the report lodged by complainant Likhit Ram Gond, a dispute occurred concerning whipping of pulse crops within the forest area. After a brief altercation, accused Dino God assaulted Likhit Ram, accused Suklal Kamar assaulted Majhiram, accused Tike God assaulted Degar Yadav and accused Madav Kumar assaulted injured Bedram. Out of the four injured, only Bedram sustained two lacerated wounds over occipital and parietal regions.

However, these wounds were not accompanied with any bony injury. Other injured have suffered simple injuries caused by club.

Considering that the applicants are tribal living within the forest area and the dispute occurred at the time of reaping the harvest and injured Bedram has not sustained any bony injury as also for the reason that the applicants are in jail since 4.9.2020 and the charge sheet has already been filed, I am inclined to release the applicants on regular bail.

5. Accordingly, the bail applications are allowed and the applicants are directed to be released on bail on each of them furnishing a

personal bond for a sum of Rs.50,000/- with one surety each in the like amount to the satisfaction of the trial Court. They are directed to appear before the trial Court on each and every date given by the said Court.
