For Respondent/State Mr. Satish Gupta, GA Hon'ble Shri Justice Sharad Kumar Gupta Order On Board 7-91. This is first bail application under Section 439 of the Cr.P.C. preferred by the applicants before this Court and their no bail application is pending before any other court.

2. The applicants have been arrested in connection with Crime No. 42/2018 registered in police station Gol Bazar, Raipur (CG) for offence punishable under Section 420/34 of the IPC.

3. Perused the case diary.

4. Prosecution story in brief is that the applicants are proprietor of Bhosle Consultancy. The applicants had taken huge amount from 24 persons and executed agreement for giving delivery of possession of super built houses, but later the applicants did not fulfill their promises and did not give possession of the super built houses to the concerned complainants nor returned back the money taken by them.

5. Counsel for the applicants argued that the applicants are innocent and falsely implicated hence they may be released on

bail.

6. On the other hand, the State Counsel opposed the bail application.

7. Looking to the facts and circumstances of the case, looking to the huge amount taken by the applicants, the number of complainants i.e. 24 and looking to the seriousness of the alleged offence and also the impact of granting bail on the society, this Court is not inclined to grant bail to the applicants.

8. Consequently, the MCRC is dismissed.
