This is an application filed under Section 439 of the Cr.P.C. for grant of regular bail to the applicants, who have been arrested in connection with Crime No.155/2016 registered in Police Station Dipika Distt. Korba (CG) for the offence punishable under Section 457, 380,34 of the Indian Penal Code.

Learned counsel for the applicants submits that the applicants have been arrested on 30.12.2016, after investigation, concerned police has filed charge sheet which is pending before Judicial Magistrate First Class, Katghora, as Criminal Case

No.116/2017. Learned counsel for the applicants would submit that charge sheet has been filed, the applicants are in jail since long, they will not commit any offence in future, as the trial may take sometime for its conclusion, the applicants may be granted bail.

Per contra, learned counsel for the State opposed the arguments advanced on behalf of the applicants and would submit that huge quantity and valuation of silver and gold ornaments were recovered from the possession of the present applicants and also they failed to give any explanation for their possession of the said ornaments, their bail application may be rejected. 5.

Perused the entire material.

On due consideration of the property recovered from the applicants, without commenting anything on its merits, I am not inclined to grant bail to the applicants.

Accordingly, the bail application filed under Section 439 of the Cr.P.C. is hereby dismissed.
