1. Heard.

2. The applicant has preferred this bail application for grant of anticipatory bail, as he apprehends his arrest in connection with Crime No.438/2020, registered at Police Station Dallirajhara Distt: Balod, Chhattisgarh for offences punishable under Sections 458, 147, 148, 149, 294, 506, 323 of the Indian Penal Code.

3. Applicant along with 10-12 accused persons formed unlawful assembly; committed lurking house trespass; criminally intimidated; and assaulted Parmeshwar Sahu & Deepak Sahu at about 9.10 pm on 1-10-2020.

4. Material available in the case diary would indicate that the injured Parmeshwar's brother is a journalist and the accused persons had a grudge against them as they were involved in

2 MCRCA No.1593 of 2020 publishing malicious news about the inhabitants of the locality.

5. The injury report of Parmeshwar & Deepak would not show any serious injuries over their person. All the offences except the ofence under Section 458 of the IPC are bailable. The applicant has no antecedents of his involvement in any heinous crime in the past.

6. Considering all the relevant aspects of the matter, this Court is inclined to release the applicant on anticipatory bail.

7. Accordingly, the application is allowed and it is directed that in the event of arrest of the applicant, he shall be released on anticipatory bail on his executing a personal bond for a sum of Rs.50,000/- (Rupees Fifty Thousand Only) with one surety in the like sum to the satisfaction of the arresting ofÏcer with the following conditions:- • he shall make himself available for interrogation by a police ofÏcer as and when required;

• he shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the Court or to any police ofÏcer.

• he shall not influence the witnesses during pendency of the trial.
