1. First bail application preferred by the applicant was dismissed as withdrawn vide order dated 15.09.2021 passed in MCRC No. 5766 of 2021.

2. The applicant has preferred this second bail application under Section 439 of Cr.P.C. as he has been arrested in connection with Crime No.608/2021 registered at Police Station- Sarkanda, District Bilaspur, C.G. for the offence punishable under Section 376-D read with 34 of Indian Penal Code.

3. Learned counsel for the applicant seeks to withdraw this bail application with liberty to file afresh as and when occasion arises.

4. Accordingly, the bail application is dismissed as withdrawn with the aforesaid liberty.
