Shri Ishaan Verma, Panel Lawyer.

Single Bench:Hon'ble Shri Sanjay S. Agrawal, J Order On Board 18.10.2021 1.

Heard on admission.

2.

The grievance of the Petitioner is to the in-action of the Respondent authorities in not taking a decision on her application made on 15.09.2021 seeking transfer from Jagdalpur to Raipur. According to the Petitioner, she was appointed on the post of Pradarshak vide order dated 18.05.2017 in Government Nursing College at Jagdalpur and since then she is performing her duties in the said post at Jagdalpur. It is contended that since the Petitioner is a lady having minor children and facing great difficulties in attending her duties, therefore, she has made an application on 08.02.2019 for her transfer from Jagdalpur to Raipur, where her husband, namely, G. L.

Chakradhari is performing his duties as Technician Grade 2 in South East Central Railway at Raipur. It is contended further that despite her said application made on 08.02.2019, no action was taken, therefore, she was compelled to file another application of similar nature on 16.07.2020 and thereafter also on 15.09.2021 but the same has not been decided so far. Counsel for the Petitioner, therefore, prays for limited prayer for the disposal of the said representation.

2.

Considering the aforesaid facts and circumstances of the case and considering further the pendency of her representation made repeatedly as observed herein above, this Court feels that no fruitful purpose would be served in keeping the petition pending as the petition can be disposed of at this stage itself.

3.

Accordingly, the petition is disposed of and the concerned respondent authorities are hereby directed to consider the representation as made by the Petitioner on 15.09.2021 as soon as possible preferably within a period of three months from the communication/ receipt of the order of this Court. 4.

It is made clear that while disposing of this petition, this Court has not expressed any opinion on the merits of the case and the concerned authorities would decide the same in accordance with law. 5.

With the aforesaid observation, the petition stands disposed of. Sd/- (Sanjay S. Agrawal) JUDGE Nikita
