Hon'ble Shri Justice P. Sam Koshy Order on Board 06.08.2019

1. The only grievance of the petitioner is that, the recruitment process for filling up of the post of Angan Badi Sahayika for the village Chunapathar Giddhipara at Ramchandrapur, District Balrampur, is being finalized by the respondent authorities without taking into consideration the objections that the petitioner has raised in respect of qualification/mark-sheet of the respondent No.5.

2. The contention of the petitioner is that, she has also participated in the same recruitment process and she has come to know that the mark sheet of respondent No.5 is a fake document and therefore she has filed an objection before the competent authority. A reminder in this regard was also given. The petitioner prays that the respondents may conduct an enquiry before finalizing the recruitment process.

-23. This court, at this juncture, is of the view that since the recruitment process has not been finalized, the cause of action for the petitioner at this juncture does not arise. Moreover, it is expected that the respondents, on receipt of complaint by the petitioner in respect of respondent No.5, shall be verifying this fact in accordance with rules before finalizing the said recruitment process.

4. With the aforesaid observations, the writ petition stands disposed of. Sd/- (P. Sam Koshy) Judge inder
