Hon'ble Shri Justice Manindra Mohan Shrivastava Order On Board 10/12/2020

1. Heard on application for grant of anticipatory bail.

2. It appears that the applicant, on apprehension, of arrest, has filed application before this Court. The applicant had already moved application for grant of anticipatory bail before the Court below and order dated 20.10.2020 passed by the Court below that in the proceedings, the prosecution under instructions from Station House Officer clearly stated that against the applicant, neither there is any allegation nor any offence has been registered nor the police is making any attempt to arrest the present applicant. Recording the aforesaid statement, the bail application was closed.

3. In the present bail application filed by the applicant before this Court, no new facts have been stated so as to say that the applicant has any apprehension that the police would be arresting him.

4. Therefore, in view of the above, the application is misplaced in law and is therefore rejected, however, with liberty to revive as and when cause of action arises.
