Shri Majid Ali, Dy. Govt. Advocate Hon'ble Shri Justice P. Sam Koshy Order On Board 20.08.2018 The present petition has been filed challenging the order dated 16.07.2018 Annexure P-1. The said order has been passed in the light of the observation made by this Court in WPS No. 4163 of 2018 decided on 26.06.2018.

The sole dispute revolves around the fact that whether after revocation of suspension order by the Authority who had placed the

petitioner under suspension could have posted the petitioner to a different place or not.

3.

The said issue, in the opinion of this Court, does not need any further discussion in the light of the decision of this Court in the case of Khadanand Patanwar Vs. State of Chhattisgarh & others decided on 08.09.2015 in WPS No. 3146 of 2015.

In the light of the aforesaid observation and also taking note of the fact that this Court had permitted the Authority for passing a suitable order for ensuring proper posting of the petitioner, the impugned order has been passed, this Court does not find any merit in the present writ petition. 5.

Accordingly, the writ petition stands dismissed. Sd/- P. Sam Koshy Judge Bhola
