The applicant has preferred this first bail application under Section 439 of the Cr.P.C. for grant of bail as he has been arrested in connection with Crime No.200/2020 registered at Police Station Sirgitti, District Bilaspur (CG), for the offence under Sections 354, 342, 294, 323 & 506 read with Section 34 of the Indian Penal Code.

Applicant along with co-accused Aarif Khan and Chandan Sao have committed lurking house trespass; criminally

intimidated; and outraged the modesty of the prosecutrix. The further case of the prosecution is that the accused also assaulted one Parmeshwar Verma when he reached at the place of occurrence and tried to save the prosecutrix. 4.

Learned counsel for the State, per contra, would oppose the bail application.

Similarly placed co-accused Aarif Khan has already been released on bail by a coordinate Bench of this Court by order dated 1-7-2020 passed in MCRC No.3578 of 2020. 6.

Considering the facts situation of the case; particularly considering the fact that the applicant is in detention since 17-10-2020; and also the fact that the charge sheet has already been filed, I am of the opinion that present is a fit case to release the applicant on regular bail. 7.

Accordingly, the bail application is allowed and the applicant is directed to be released on bail on his executing a personal bond for a sum of Rs.50,000/- with one surety in the like amount to the satisfaction of the trial Court. He is directed to appear before the trial Court on each and every date given by the said Court.
