1. In view of specific bar contained in Section 15 of the Chhattisgarh Protection of Depositors' Interest Act, 2005 with respect to maintainability of anticipatory bail application, learned counsel for applicant seeks permission of this Court to withdraw this anticipatory bail application. However, he submits that applicant is a government servant and there is no allegation of inducement against him, hence a direction may be issued to the Court below concerned for considering regular bail application of applicant on the same day, if filed by him after his surrender.

2. Mr. Alok Nigam, learned State Counsel submits that he is not having any objection on the submission made by learned counsel for applicant.

3. In view of above, this anticipatory bail application is dismissed as withdrawn. If an application for grant of regular bail is filed by applicant after his surrender, the Court below concerned may try to consider and decide it on the same day, if possible, in accordance with law.
