1. The challenge in the present writ petition is to the order Annexure P/1 dated 06.08.2018, whereby the service of the petitioner has been transferred from Rajpur to Kusmi, District BalrampurRamanujganj.

2. The contention of the petitioner is that the earlier order of transfer of the petitioner was made by the State Government vide order dated 14.08.2017 transferring the petitioner from Wadrafnagar to Rajpur and the said order was given effect to only on 16.04.2018 and joining was given on 30.05.2018 and in just about two month's time fresh order of transfer has been issued, thus it is a case of frequent transfer. Moreover the order of transfer now has been issued by the Collector, though it appears to be an internal change of posting, yet it is within a short span of time without any justifiable reasons.

Given the said facts and circumstances of the case, this Court is of the opinion that let the petitioner file a detailed representation to the respondent No.2 in this regard within a period of 10 days from today and in turn the respondent No.2 shall take a decision within an outer limit of six weeks. Meanwhile the respondent No.2 shall not give effect to the impugned order (Annexure P/1) so far as the petitioner's place of posting is concerned.
