1. Heard.

2. This is an application filed under Section 439 of the Code of Criminal Procedure for grant of regular bail to the applicant, who has been arrested in connection with Crime No.550/2020 registered at Police Station Lormi, Mungeli for the offence publishable under Sections 307 and 34 of the IPC.

3. The applicant and co-accused Bharat Rajput have assaulted victim Nutan Rajput by club and brick, causing fracture of frontal bone and other injuries.

4. The material available in the case diary reveals that the injured is the brother-in-law of the present applicant. On accusation that the injured is ill-treating his wife i.e. sister of the applicant and has deserted her, the assault was made on the date of the incident.

5. Considering that the applicant is in jail since 28.9.2020; the charge sheet has already been filed; and at the time of the incident, the injured was under the state of alcoholism, I am inclined to release the applicant on regular bail.

6. Accordingly, the bail application is allowed and the applicant is directed to be released on bail on his furnishing a personal bond for a sum of Rs.50,000/- with one surety in the like amount to the satisfaction of the trial Court. He is directed to appear before the trial Court on each and every date given by the said Court.
