1. This appeal by the accused/appellant under Section 14-A (II) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989 is directed against the order dated 23.09.2020 passed by the Special Judge, Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, Koriya (Baikunthpur), District Koriya, C.G., refusing to allow his regular bail under Section 439 Cr.P.C. The appellant is in jail since 02.11.2019 in connection with Special Criminal Case No.54/2019 registered at Police Station AJAK Bainkuthpur, District Koriya, C.G.
2. Though the prosecutrix has been served with the notice, however, neither she is present in person, nor is there any representation on her behalf.
3. Learned counsel for the appellant seeks to withdraw this appeal with
liberty to file afresh as and when occasion arises.
4. Accordingly, the appeal stands dismissed as withdrawn with the liberty as stated above.
