1. Heard.
2. This is an application filed under Section 439 of the Cr.P.C. for grant of regular bail to the applicant, who has been arrested in connection with Crime No.01/2020, registered at Police Station Farsegarah, Dist. Bijapur C.G., for the offence punishable under Sections 302, 307, 309 of the I.P.C.
3. The applicant is a Constable in the Chhattisgarh Armed Forces. At about 7-7:30pm on 1.2.2020, he opened fire with his service riffle causing death of fellow Constable Ravi
MCRC No. 8289 of 2020 Ranjan Singh and injured Constable Md. Sharif.
4. This bail application has been filed on merits as well as on medical ground. Having seen the material available in the case diary, no case for releasing the applicant for the entire period of trial, is made out, therefore, the bail application is dismissed.
5. In so far as prayer for temporary bail is concerned, this Court had call for medical report of the applicant which is reported to be normal.
6. Mr. B.P. Singh, learned counsel for the applicant submits that applicant had also sustained injuries in the same incident and is critically ill. The said fact is not properly reflected in his medical report. However, having appreciated the submission, the Jail Authorities are directed that the applicant shall be provided proper and adequate medical treatment as and when the same is needed.
7. Accordingly, the bail application is dismissed with above observations.
