Versus

1. The State of Chhattisgarh Through Secretary, Department of Health and Family Development, Mahanadi Bhawan, New Raipur, Police Station Rakhi, Revenue and Civil District Raipur Chhattisgarh

2. Director, Directorate, State Health and Family Welfare Institution, Raipur, Revenue and Civil District Raipur Chhattisgarh

3. Chief Medical and Health Officer, Raipur, Revenue and Civil District Raipur Chhattisgarh

4. Block Medical Officer, Community Health Centre Arang, Raipur, Revenue and Civil District Raipur Chhattisgarh ---- Respondents For Petitioner :

Shri Rupesh Shrivastava, Advocate For State :

Ms. Sunita Jain, Panel Lawyer Hon'ble Shri Justice P. Sam Koshy Order On Board 04.12.2018 1.

The challenge in the present writ petition is to the transfer order Annexure-P/1 dated 23.05.2016 transferring the petitioner from the Primary Health Center, Mandir Hasoud, District Raipur to District Hospital Bemetara. 2.

Initially this Court had refused to grant interim order but subsequently the order was granted to extent that no coercive steps shall be taken against the petitioner. By efflux of time, the grievance of the petitioner must have been rendered infructuous inasmuch as either the petitioner must have

complied with the order of transfer or he must have been permitted to remain at the original place of posting.

3.

Be that as it may, the writ petition stands disposed of with a direction to the respondents that they shall not act upon the impugned order dated 23.05.2016 so far as the petitioner is concerned any further and reserving the right of the respondents to pass an appropriate order in case if administrative exigency so arises.

4.

The writ petition stands disposed of.
