Heard the matter finally.

Learned counsel for the applicant would submit that the applicant held arrested in connection with Crime No.28/17 on 27-02-2017 by police of P.S. Bagicha, District Jashpur, C.G. for the offence under Section 20(b)(ii)(B) of the Narcotic Drugs and Psychotropic Substances Act, 1985 (in short 'the Act, 1985'). Police had filed charge sheet, which is pending before the Special Judge under the Act, 1985 Jashpur, C.G. as Special Criminal Case No.04/17. As per the allegation, 2 Kg. 100 gram Ganja has been seized. He is the first offender. He will not commit any offence in future. He may be granted bail during trial.

Per contra, learned counsel for the non-applicant/State opposed the argument advanced on behalf of the applicant. 4.

Perused the matter.

As the Ganja so seized from possession of the applicant in the manner, it goes to show that the applicant involved in illegal sale of said Ganja. On due consideration, I am not inclined to grant bail to the applicant. Consequently, the instant MCRC is hereby dismissed.
