On due consideration and for the reasons stated in the application, the delay of 68 days in filing the petition is condoned.

Having heard learned counsel for the appellant and after perusal of the statement of PW-3, leave to appeal under Section 378(3) of Cr.P.C. is granted. Registry is directed to register the case as Acquittal Appeal.

Since the respondent is already been represented, list for final hearing.

Respondent shall produce bail bonds for Rs.25,000/- before the Court below.
